The information takes also inspiration from the Recommendation n.2/2001 that European authorities for the protection of personal information – united with the Group created by art. 29 of instruction n. 95/46/CE – took on May 2001, 17th to individuate some minimum qualifications for the collection of personal information on line and, in particular, the procedures, the time and the nature of the information that the holders of the treatment have to communicate to the users when they link to any web page, independently from their aims.

In consequence of the consultation of this web site, dates referring to identified or identifiable people can be treated.

The "holder" of the treatment is Mecondor S.p.A., with registered office in Milan (Italy), Via Nino Bixio 30 and headquarters in Sulbiate Superiore (Mi), Via P.Mascagni n.8 – as indicated on the first page of this web-site.

The Direction of the Company is the responsible of the treatment; any request to practice the rights concerning privacy (ex Art. 13) should be asked to the Direction.

 

PLACE OF PERSONAL INFORMATION

 

The treatments connected to the web services of this site take place by the administrative and operative offices and they are carried out only by the staff of the entrusted office or, possibly, by eventual people in charge of occasional operations of maintenance.

 

No data deriving from the web service will be spread or transmitted.

 

Personal information sent by consumers who forward demand of shipment of informative material are usable to the aim to only execute the service or the demanded performance and are communicated to third party in the single case in which that it is to such necessary aim.

 

KINDS OF PERSONAL INFORMATION

The data are used only to obtain anonymous statistic information and to control the right working of the web site and they are erased immediately after the elaboration.

RIGHTS OF INTERESTED PARTIES

 

The subjects that are referred the personal information, have the right to obtain in any moment the confirmation of the existence of these data, to know the contents and the origin, to check the correctness, to ask for integration, updating or rectification (Art. 7 d.lgs. 196/2003).

In the terms of the same article the subjects have the right to ask for cancellation, anonymous transformation or the block of treated information by infringing the law; the subjects have also the right to oppose the treatment lawfully.

 

Art.13

Informative report

  1. The interested party or the person by whom personal information are collected, orally or in writing informed in advance for what concerns:
  1. The purpose and the procedure of personal information treatment;
  2. The obligatory or optional nature of the appointment data;
  3. The consequences of an eventual refusal to answer;
  4. The subjects or category of subjects that could get to know about personal information as responsible and, the framework of spreading data;
  5. The rights of Article 7;
  6. The identifiable details of the holder and, pursuant to Art.5, of the representative in the territory of the State and of the responsible; when there are more than one responsible, at least one of them is indicated, indicating the site of communication net and the procedure to know the updated list of the responsible people. If there is a responsible, his name has to be indicated.
  1. The information, subsection 1, contains also the elements estimated by specific arrangements and it could not include the elements already known by the person who provides the data or elements that, if known, could obstruct supervisory functions developed in order to defend the Sate or to prevent, to verify or to repress crimes.
  2. The Guarantor could individuate, by own measures, simplified procedures for the information provided by telephone service dealing with assistance and information to the public.
  3. If the personal information are not collected by the concerned party, the information, subsection 1, including the typology of treated data, is given to the interested party when the information are recorded or when they have to be communicated.
  4. The arrangement, subsection 4, could not be applied when:
  1. The data are treated following a liability provided by the law, by a regulation or by a prescription of the Community.
  2. The data are treated to develop defensive investigations – law n. 397, December 7th, 2000 – either to assent or to defend a right in judicial seat;
  3. The information involves the use of means that, according to the Guarantor, are out of proportion in relation to the protected right or when it reveals, in the opinion of the Guarantor, the information is impossible.
